Top Ten Tips – Know your Customer

When taking on a new customer it is important you know who you are dealing with:- Is your customer a Sole Trader, Partnership, Limited Company or a Public Limited Company?
Some pointers to help you….

  1. Obtain a letterhead from your customer.
  2. Ensure you complete a credit account application form.
  3. For a Limited Company take note of their Company Registration Number.
  4. Make sure you have a number of alternate ways to contact your customer.
  5. Provide your customer with your ‘Terms and Conditions’. Make sure you have incorporated them and avoid allowing your customer to trade on their terms.
  6. Complete a credit check to ensure they are creditworthy for the credit limit you are about to give them.
  7. Ensure your credit terms are adhered to.
  8. Do not increase your customers credit limit
    too soon.
  9. Avoid obtaining trade references….. They are not worth the paper they are written on!
  10. If the customer defaults on payment chase the debt early.

This is what our Client’s are saying, we have listened and have had the ‘Client Information’ on the Letter Before Action instruction page enabled for Auto Fill.

This means that as long as you have enabled ‘auto fill’ on your browser, when you start to enter your details your ‘browser’ will give you the option to complete the line.

To enable auto fill follow the process below:-

  1. Open Internet Explorer.
  2. Click the Tools  button, and then click Internet options.
  3. On the Content tab, under AutoComplete, click Settings.
  4. Select the User names and passwords on forms tick box. If you want to automatically save all user names and passwords without being asked each time you visit a new site, clear the Ask me before saving passwords tick box.
  5. Click OK, and then click OK again.

Important Information for all our Clients.
Proposed changes to ‘Pre-Action Protocol’ when dealing with Individuals / Sole Traders.

The Ministry of Justice are proposing a change to the Pre-Action Protocol to replace the existing way in which your debts are chased prior to legal action.

Sole Traders make up 62% of all businesses in the UK

The proposal suggests that prior to taking legal action the Sole Trader should be provided with:-

  • A fully detailed letter of Claim
  • Copy documentation
  • Be given 30 days to respond
  • If the Debtor does respond they will be given an additional 30 days before further action can be taken
  • In the absence of an agreement being made a further 14 days notice has to be given before legal proceedings can be issued
  • Consideration must be given to Alternative Dispute Resolution

We consider this proposal to be both unfair and disproportionate having a negative effect on our Clients cash flow.

We have responded highlighting our concerns for businesses to the proposal via the consultation document but suggest that our Clients (only if you deal with Individuals or Sole Traders) familiarise themselves with the proposal and although the consultation has closed make their feelings known by contacting their MP.
