New Pre-Action Protocol from 1st October 2017 – How will this affect you?

A new Pre-Action Protocol has been introduced from the 1st October 2017 in relation to what is required in sending a letter of claim to Sole Traders and Individuals.

The Protocol does not apply to business-to-business debts unless the Debtor is a Sole Trader.

The Court Protocol focuses on the conduct that the Court would normally expect from those parties prior to the start of proceedings. This is particularly relevant to those Clients whose customers are Individuals or Sole Traders.

The aims of the Protocol are to encourage early engagement of communication between the parties without the need to start Court proceedings.As part of the new process where we receive instructions against those businesses aforementioned which fall into this category we will contact you to discuss your options.

The main issue being that if it is your intention to issue Court proceedings then it will be necessary to send a compliant Pre-Action Protocol letter along with the pack which is sent with the letter to be completed by the Debtor.
